These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Buyer," "User," "you") and Kairo Digital Solutions LLC ("StayCanada™," "we," "us," "our"), governing your access to and use of staycanada.ca and all affiliated product pages, subdomains, and digital properties (collectively, the "Platform"). By accessing the Platform, completing a purchase, or clicking any "Buy," "Get Access," "Secure My Status," "Complete My Order," or similar purchase confirmation button, you unconditionally accept and agree to be bound by these Terms in their entirety. If you do not agree, do not access the Platform or make any purchase.
By completing any purchase on the Platform or any affiliated product page, you expressly represent and warrant that: (a) you are at least 18 years of age and have full legal capacity to enter into binding contracts; (b) you have read, understood, and agree to these Terms in their entirety prior to completing your purchase; (c) your act of clicking the purchase confirmation button constitutes your electronic signature and binding acceptance of these Terms; and (d) these Terms supersede any prior representations, statements, marketing materials, video content, testimonials, or communications of any kind, whether written or verbal, that you may have encountered on the Platform or any affiliated property.
Your purchase confirmation serves as a timestamped, legally binding record of your acceptance of these Terms. This record is retained and may be submitted as evidence in any dispute, chargeback proceeding, arbitration, or legal action.
StayCanada™ is a digital educational information portal operated by Kairo Digital Solutions LLC. All content, tools, frameworks, and materials within the portal (collectively, "Digital Products") are provided solely for general educational and informational purposes only.
Nothing contained in any Digital Product constitutes, or should be construed as, legal advice, immigration advice, legal representation, or any other form of licensed professional advice. No professional relationship of any kind is created between StayCanada™ or Kairo Digital Solutions LLC and the Buyer by virtue of any purchase or use of a Digital Product.
StayCanada™ is not a law firm, licensed Regulated Canadian Immigration Consultant (RCIC), government agency, or licensed advisor of any kind. You are solely responsible for any decisions you make based on information contained in any Digital Product, and you are strongly encouraged to consult a qualified licensed professional before taking any action regarding your immigration status.

Due to the digital nature of all products sold on the Platform, access to Digital Products is delivered electronically within 2 hours of purchase confirmation. All Digital Products are delivered electronically. Upon successful payment confirmation, access instructions and portal login details will be delivered to the email address provided at checkout within 2 hours of purchase confirmation. Delivery times may vary depending on payment processing, email delivery services, and other factors outside our direct control.
Kairo Digital Solutions is not responsible for delivery failures caused by: incorrect email addresses provided by the Buyer, spam or junk mail filters, email provider restrictions, or other technical issues outside our control. It is the Buyer's sole responsibility to provide an accurate email address and to check all folders including spam and junk mail before contacting support.
If you have not received access within 2 hours of purchase, you must contact us at contact@kairodigitalsolutions.co before initiating any dispute with your payment provider or bank. Failure to contact us first before initiating a dispute constitutes a breach of these Terms.
Kairo Digital Solutions reserves the right to modify, update, or discontinue any Digital Product at any time without notice. Access may be revoked at any time if we determine, in our sole discretion, that these Terms have been violated.
STAYCANADA™ AND KAIRO DIGITAL SOLUTIONS LLC MAKE NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND REGARDING THE RESULTS, OUTCOMES, OR BENEFITS THAT ANY BUYER MAY ACHIEVE THROUGH THE USE OF ANY DIGITAL PRODUCT.
Individual results vary significantly based on factors entirely outside our control, including but not limited to: individual effort, personal circumstances, immigration status, country of origin, employer situation, IRCC processing times, regulatory changes, government policy changes, CRS scores, permit type, and consistency of application. Any results, case studies, testimonials, or examples shown on the Platform or any affiliated property reflect individual experiences and are not representative of typical or expected outcomes.

Initiating a chargeback or payment dispute without first contacting Kairo Digital Solutions constitutes a material breach of these Terms and triggers the following consequences:
You acknowledge that your purchase confirmation, timestamped acceptance of these Terms, and delivery confirmation collectively constitute sufficient evidence to successfully contest any chargeback or dispute filed without prior contact with our support team.
Kairo Digital Solutions collects personal information including but not limited to: name, email address, payment information (processed securely by third-party payment processors — we do not store card numbers), device information, IP address, and browsing behavior on the Platform. We use this information for order fulfillment and delivery, customer support, marketing communications (with opt-out available), analytics and Platform improvement, and fraud prevention.
We do not sell your personal information to third parties. We may share information with trusted service providers (payment processors, email platforms, analytics providers) solely for the purpose of operating the Platform and fulfilling orders. We comply with applicable Canadian privacy laws (PIPEDA). You may request deletion of your personal data by contacting contact@kairodigitalsolutions.co. Data is retained for a minimum of 7 years for legal and tax compliance purposes.
All content, materials, frameworks, templates, tools, videos, graphics, copy, and other intellectual property contained in any Digital Product or on the Platform is the exclusive property of Kairo Digital Solutions LLC and is protected by applicable copyright, trademark, and intellectual property laws. Upon purchase, you receive a limited, non-exclusive, non-transferable, non-sublicensable personal license to use the Digital Product for your own personal, non-commercial purposes only.
You may not reproduce, copy, distribute, republish, upload, post, transmit, resell, sublicense, or create derivative works from any Digital Product or Platform content without the express prior written consent of Kairo Digital Solutions LLC. Violation of this section may result in immediate termination of access and legal action.
THE PLATFORM AND ALL DIGITAL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. KAIRO DIGITAL SOLUTIONS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAIRO DIGITAL SOLUTIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY DIGITAL PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR ANY DIGITAL PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC DIGITAL PRODUCT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Kairo Digital Solutions LLC, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform or any Digital Product; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any fraudulent or bad-faith chargeback or payment dispute initiated by you; or (e) any content or information you provide to us.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, OR ANY DIGITAL PRODUCT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTION OF ANY KIND AGAINST KAIRO DIGITAL SOLUTIONS.
Arbitration shall be administered by the ADR Institute of Canada under its Commercial Arbitration Rules. The arbitration shall take place in Mississauga, Ontario, Canada, or via videoconference at the arbitrator's discretion. The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction. Each party shall bear its own costs unless the arbitrator determines otherwise.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in Mississauga, Ontario, Canada.
Kairo Digital Solutions reserves the right, in its sole and absolute discretion, to terminate or suspend your access to the Platform and any Digital Products at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, chargebacks, abusive conduct, or any activity deemed harmful to the Platform or our business. Termination does not entitle you to any refund.
Kairo Digital Solutions reserves the right to modify, update, or replace these Terms at any time in our sole discretion. Updated Terms will be posted on the Platform with a revised "Last Updated" date. Your continued use of the Platform or any Digital Product following the posting of updated Terms constitutes your binding acceptance of the revised Terms.
These Terms constitute the entire agreement between you and Kairo Digital Solutions LLC with respect to the subject matter herein and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, including any representations made in marketing materials, video content, testimonials, or promotional content. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
